Data privacy policy
The operation of this applicant management system fulfils the requirements of the Swiss Data Protection Act (DSG) as well as of the EU General Data Protection Regulation (GDPR) for the processing of personal data. It is certified in line with EN ISO/IEC 27001 and ISO 27001 on the basis of IT baseline protection from the German Federal Office for Information Security (BSI).
Protecting your privacy when processing personal data is an important concern for SMS Concast AG. We do not collect or use personal data unless it is authorized by a legal provision or you have given your consent beforehand.

Purpose and legal basis of processing
You can use our online application system to apply for a current vacancy or to submit a speculative application.
The Swiss Data Protection Act as well as the EU General Data Protection Regulation allows us to process personal data of employees for purposes connected with employment relationships if this is necessary for making decisions concerning an employment relationship or establishing an employment relationship. Data protection law also counts applicants as employees. The primary legal basis for this is article 12, 13 Swiss DSG (similar art. 6 subsection 1 b) of the GDPR. In certain cases, processing can be conducted on the basis of your prior consent in line with article 4 Swiss DSG (respectively art. 6 subsection 1 a), 7 of the GDPR.
Personal data
Personal data includes all information that refers to an identified or identifiable individual person, e.g.: name, ID number, location data, online ID or special features that express the physical, physiological, genetic, psychological, economic, cultural or social identity of this individual.
Categories of processed data
We only process the information provided by you in the application management system for the purposes of processing applications. In particular, the categories of personal data include your master data (such as first name, last name, nationality), contact data (such as private address, (mobile) telephone number, email address) and statements concerning your educational and professional career, including your CV, references and other applicant data and documents, e.g. photographs.
Personal data recipients
All data that is collected and processed during the course of an application submission to SMS Concast AG is protected against unauthorized access, manipulation and loss by technical and organizational measures.
Only certain employees of SMS Concast AG are authorized to access personally identifiable applicant data. These employees guarantee the confidentiality of this sensitive data during processing for its intended purpose. Your personal data can be accessed by the respective human resources manager at SMS Concast AG and may be made available to the responsible executives. They are forbidden to use the data for purposes other than those named above. Our employees have submitted a confidentiality obligation for data protection in line with our privacy policy.
Data transfer to third countries outside Switzerland or the EU
The data is processed generally in Switzerland, in the Federal Republic of Germany, in a member state of the European Union or in another member state of the Agreement on the European Economic Area. As far as within the framework of the international operations of SMS Concast AG are transferred to companies affiliated with SMS Concast AG, data will be disclosed such third countries, that are not considered having an equivalent data protection legislative framework in place, the data will only be transferred based on the recommended standard contractual clauses for the transfer of personal data to third countries or based on Binding Corporate Rules .
Storage period criteria
If you do not arrange to have your data deleted, it will be stored for 6 months after your application process has been concluded, even if the SMS Concast AG has previously rejected the application. The data will be completely deleted after this period.
Your rights as an affected party
You can request information on the data stored concerning you from the address given above. You can also request the correction or deletion of your data under certain conditions. Data that is required to be stored due to statutory provisions or for the correct handling of business transactions is exempt from this provision. You may also be entitled to limit the processing of your data or request the release of the data you provided in a structured, conventional and machine-readable format.
Right of appeal
You have the right to revoke consent at any time if your data is processed on the legal basis of your prior agreement, e.g. for subscription to our job newsletter. The legality of processing the data on the basis of your consent until the time at which it is revoked remains unaffected. We will then no longer process your personal data unless we can prove compelling and legitimate grounds for processing that outweigh your interests, rights and freedoms or if processing is necessary for the assertion, exercise or defense of legal claims.
Right of complaint
If you are dissatisfied with the use of your personal data, you have the option of contacting the data protection officer named above or a data protection supervisory authority.
Disclosure to third parties for legal or contractual reasons
We treat this data with absolute confidentiality in line with the provisions of the Swiss Data Protection Act respectively the GDPR and will not disclose it to third parties without your consent. Additionally, we may disclose your personal data to further recipients outside the company if this is necessary to fulfil contractual and statutory obligations.
Your obligations as a user of the application management system
The personal data you enter must be true, correct and up to date and must not be incomplete, misleading or deceptive.
As a user of the SMS Concast AG online application system, you agree not to disseminate unlawful content or violate other rights of third parties.
The user is responsible for all content that they enter into the SMS Concast AG online application system, e.g. text, photos, graphics, files, links etc. They agree not to violate any brand rights, copyrights, personal rights or other rights of third parties.
